Terms and Conditions

1. Delivery is from receipt of down payment, and receipt of approved graphics required for manufacturing graphic works.
2. If graphic file is not camera ready then a set up charge will apply (One time only per each graphic).
3. Customers to pay initial set up fee at time of order. This fee will be non-refundable once the graphics are ordered.
4. Customer to supply graphic file in a camera ready format. If the file is not camera ready, graphic fees will apply.
5. Sleeve is built to fit standard variable cup industry standards.
6. Pricing in CAD dollars for Canadian customers and in USD for US customers. All orders are subject to applicable sales tax.
7. cup-a-round^TM sleeves FOB cup-a-round^TM , and shipments for overseas will be via sea if required. (4 weeks delivery).
8. Terms are as per RFQ 50% with order, 50 % @ delivery.
9. Quote is valid for 30 days and is subject to review upon receipt of approved work order and approved graphics for any found unknowns.
10. Prices are subject to change without notice.  All newly published prices will supercede any previous price list effective immediatly upon published date.
11. Prices quoted are for volume stipulated.
12. All payment must be received certified cheques, money orders, bank draft, or bank transfers.  All returned payments are subject to a $45 USD service charge per occurrence.

CUP-A-ROUND^TM

LIMITED WARRANTY

Subject to the terms and conditions contained herein, 1675029 ONTARIO INC. ("CupARound") warrants to the Customer that all coffee cup sleeves and beverage container sleeves (the "Products") will be free from defects in material and/or workmanship under normal use and service from the date of first sale, for up to one (1) year.

 The limited warranties set out herein are the Customer's exclusive remedy. The limited warranties are extended for the Customer only and are not transferable.

These limited warranties apply solely if:

I) The Product(s) were purchased from an Authorized CupARound Dealer, in the ordinary course of business;

II) The Products have not been modified, altered, tampered with, or operated outside of their stated tolerances;

III) The Product(s) have not been modified;

IV) The Product(s) have not been used for any purpose other than which they were intended, and have not been used in an application that in any way exceeds the specification published at the time of manufacture; and

V) The Products have not been subject to excessive heat or cold.

This limited warranty is subject to the following EXCLUSIONS:

I) ABUSE & MISUSE: Defects or damage that results from improper operation, storage, misuse or abuse, accident or neglect such as physical damage due to use exceeding the product's specifications or any other acts which are not the fault of CupARound are excluded from coverage.

II) UNAUTHORIZED SERVICE OR MODIFICATION: Defects or damages resulting from imprinting, cutting, alteration or modification in any way by someone other than CupARound, or an Authorized CupARound Dealer, are excluded from coverage.

III) ALTERED PRODUCTS: Products with (a) stamping that has been removed, altered or obliterated; (b) marks that show evidence of tampering or alteration; (c) non-conforming or non-CupARound marking; are all excluded from coverage.

 CupARound, at its option, will repair or replace any defective parts, during the period covered by this warranty. CupARound may in its sole discretion use functionally equivalent reconditioned / refurbished / pre-owned or new Products to complete the warranty. All replaced, defective Products shall become the sole and exclusive property of CupARound.

The obligation of CupARound under this warranty is limited solely and exclusively to repairing or replacing, as CupARound may elect, any part or Products which are returned to CupARound, transportation prepaid, and which, upon examination, are determined by CupARound to be defective in material and workmanship. Any third party warranties that may be applicable to components of the Products shall be covered only by this Limited Warranty, with no additional warranty of kind or nature, whether express or implied, provided by CupARound.

Any implied warranties, including without limitation the implied warranties of merchantability or fitness for a particular purpose shall be limited to the duration of this warranty, otherwise the repair or replacement as provided under this express limited warranty is the exclusive remedy of the Customer, and is provided in lieu of all other warranties, express or implied.

In no event shall CupARound be liable, whether in contract or tort (expressly including negligence) for damages or any other form of legal relief or thing to be granted by a Court in excess of the purchase price of the Product(s). Nor will CupARound be liable for any indirect, incidental, special or consequential damages of any kind for items such as but not limited to loss, damage or injury to equipment or property on which the Products are used; or loss or damage to other goods, products, equipment or persons as a result of use or operation of the Products; or delayed or loss of revenue or profits, delayed or loss of business, or other financial loss or delay arising out of or in connection with the ability or inability to use the Products to the full extent these damages may be disclaimed by law. Without limiting the foregoing, the Customer assumes all risk and liability for loss, damage or injury to the Customer or others arising out of the use, misuse, or inability to use the Products.

CupARound reserves the right, at any time, to make changes in the design, material and/or specification of this product, or accessories thereof, without thereby becoming liable to make similar changes in such equipment or accessories previously manufactured.
